#428  Ethics: EMAIL AND TECHNOLOGY in LEGAL PRACTICE

Do you ever use email in your law practice?  How about drafting legal documents and pleadings on the computer?  Or drafting discovery documents or transactional documents and emailing them or filing them online?

In this session, we will discuss two important emerging areas of legal ethics and technology.  First, we’ll deal with confidentiality issues involving email as part of your legal practice.  For example, do attorneys have to encrypt emails they send to their clients?  Is there a reasonable expectation of privacy for email, similar to what attorneys enjoy for telephone or facsimile transmissions?

Second, we will look a closer look at a specific ethical issue regarding technology that is gaining prevalence in today’s legal landscape; the return of electronic versions of correspondence, pleadings, and other legal documents to clients upon the termination of representation.  We know that attorneys are generally obligated to turn over their client file to a client who seeks to terminate representation for any reason, but what about electronic versions of documents created by the attorney?  Is that work product included in what must be returned to the client?  What ethical implications does that issue create?  What about matters relating to the attorney’s intellectual property and potential malpractice concerns from clients manipulating or changing legal pleadings or transactional documents?
